Foundation agreements and awards

The Establishment Agreement and Remuneration Modernization Act (the “Act”) came into effect on 1 January 2018 and is an overhaul of the way workplace and awards agreements are concluded in Australia.

As part of this law, all Foundation and Awards agreements issued from January 1, 2018 onwards must include the National Employment Standards (NES). NES are the minimum terms and conditions of employment that apply to all employees, with or without a written agreement.

The law also created two new categories of employment: "affected employees" and "unaffected employees." An affected employee is an employee subject to a term in an organization or award agreement that differs from the minimum terms set forth in the NES. An unaffected employee is an employee who is not subject to conditions in an organization or award agreement that differ from the minimum conditions set forth in the NES.

If you are an affected employee, you are entitled to the same pay, hours, vacation, and other working conditions as an unaffected employee. If you are an unaffected employee, you are not entitled to receive any pay, hours, vacation, or other terms of employment that differ from those that apply to an unaffected employee in an organization or award agreement issued January 1, 2018 onwards.

Of course, every business owner is free to negotiate terms that differ from the NES. However, if the employer decides to enter into an agreement or decision that differs from the NES, it must be recorded in writing and made available to each affected employee upon request. This will help ensure that all employees have a clear understanding of their rights and obligations under an agreement or arbitral award.
